Terms of Use

1. This document describes the terms of use of the Virtual Teacher mobile learning application (hereinafter we will use the term "Application"), made available to users by the company under the name Maciej Rozenbajgier (hereinafter we will use the terms "Provider" or "we") via the Google platform Play.
2. You can install the application on a mobile device with the Android system, in particular, it may be a mobile phone / smartphone (hereinafter referred to as "Device"). You install via the Google Play Store platform.
3. The Application works by enabling you to create your own learning material, such as words, definitions, text fragments, etc. (hereinafter we will refer to them as "Material" or "Materials") and then learn it by repeating it periodically. The application has mechanisms that facilitate the creation of the Material and its learning, such as: automatic translation of the entered text or searching for pictures on the Internet and their presentation during learning thanks to the built-in web browser module. The application also uses mechanisms built into your Device, such as: speech recognition and text-to-speech processing. Virtual Teacher presents the estimated level of your mastery of the Material and offers you the optimal repetition dates. In addition, the Application allows you to share your Materials with other users of the Application.
4. To use Virtual Teacher you must have an Android device and an Internet connection in the form of data transmission over a cellular network or an enabled Wi-Fi connection. You acknowledge and accept the fact that payments may be collected for data transmission that you make with your Internet service provider (e.g. telecommunications operator) on your own and you cannot charge the Provider with such fees.
5. You must have a Google account (GMail address and Google password) to use some of Vitual Teacher's features, such as multi-device learning, sharing Materials, and using Materials provided by other users. You can get such an account from Google, e.g. when setting up an e-mail in the GMail service. When signing in, Virtual Teacher will display the Google accounts that are already set up on your Device. You can choose one of these accounts to log in. You can also manually add another Google Account that you want to use to sign in to the App and that is not shown on the list. You do this by manually entering the username and password of your chosen Google account. The processing of your data related to the Google account and the security of the login process are described in the Terms of Use of Google services and Google's Privacy Policy .
6. In order to meet the legal requirements, we need to know your age, so when creating a Virtual Teacher account we will ask you about your year of birth. You declare that the year of birth provided by you when creating the account is correct.
7. You agree to use the Application in a manner that does not infringe any laws in force in any country in which the Application is available.
8. You are fully responsible for the content you post in the Materials you have created and for the consequences of sharing this content with other users. At the same time, you undertake to comply with the generally accepted rules of publishing content on social media, including the commitment that you will not disseminate inappropriate content (offensive, vulgar, etc.) and that you will not violate any personal rights of others with the use of Virtual Teacher. people, as well as a good image of companies, state institutions and other organizations.
9. You consent to the processing of data provided by Virtual Teacher to the IT system supporting the operation of the Application (hereinafter the "IT System"). The IT System consists of services performed using cloud computing resources provided by Google, including Google Firebase and Google Cloud Platform. The method and principles of processing this data by the above platforms is described in the relevant documents relating to them, published by Google.
10. The supplier is not responsible for:
    1. The inability to use the Application by you or the Application malfunctions on your Device, which occurred due to:
       1. Your improper handling of the application,
       2. Malfunction of your Device,
       3. Malfunctioning of the Internet access service on your Device (e.g. limited network routing, limited transfer speed, service instability),
       4. Restrictions imposed on the Internet access service of your Device or the Device itself, e.g. firewall, anti-virus software, etc.,
       5. Your use of a device whose Android operating system is not compatible with the requirements of the current version of Virtual Teacher,
       6. You do not have a Google account,
       7. Other reasons.
    2. Loss of data provided by you to the IT System caused by any error on the part of the Provider or Google, and reasons attributable to you,
    3. Any consequences of the lack of learning progress when you learn with the Virtual Teacher,
    4. Any consequences of you learning wrong content with Virtual Teacher, because you are the creator of the Materials. This also applies to the case when Virtual Teacher automatically completes the Materials using the mechanisms of translation and image search. You are fully responsible for verifying the substantive correctness of the Materials that you create, as well as those that are shared by other users, and you intend to use them for learning.
    5. Any consequences of sharing the Material by you with other users of the Application,
    6. Any consequences of your access to the Material shared by another Virtual Teacher user,
    7. Non-compliance of the estimated level of your mastery of the Material with the actual state,
    8. Any effects of the actions of third parties in relation to the Application or the IT System, e.g. hacking attack, hacking into the system,
11. Virtual Teacher can show you ads while you are using it. You consent to it and you will not submit any comments or claims arising from this fact.
12. You agree to grant Virtual Teacher the right to download images on your behalf by Google Search and present the results to you conveniently in the application's user interface. The image search engine works exactly the same as if you were doing it yourself using the Google search engine in your web browser. You also agree that Virtual Teacher will store images selected by you from Google search results presented in Virtual Teacher and will not store other images not selected by you. You agree that Virtual Teacher will provide the image search functionality described above as long as it is technically possible and lawful.
13. The Application may give you the option to provide financial support to the Application Provider. Your financial support is completely voluntary and does not give you any rights to the Application and does not create any other obligations of the Provider towards you. You declare that you will not claim any rights against the Provider for providing financial support to the Application Provider.
14. By installing Virtual Teacher on the Device, you agree to all of the above Terms of Use. If you do not accept the Terms of Use, do not install Virtual Teacher. If you already use Virtual Teacher and you do not agree to the Terms of Use, please uninstall it from your devices. Removing the Application from the mobile device is tantamount to the termination of using the Application.
